Media Miss by the right: ICE memo broadens warrantless arrest authority
A newly issued ICE memo broadens the circumstances under which agents can make warrantless arrests, allowing officers greater discretion to argue that seeking a warrant could give a suspect time to flee.
The guidance also expands agents’ ability to carry out so-called “collateral arrests,” permitting them to detain unauthorized immigrants encountered during operations, even if those individuals were not the original target.
