Appeals court declines to reimpose use-of-force restrictions on agents in Minnesota

The Eighth Circuit Court of Appeals granted a full stay of a lower court’s ruling, allowing U.S. Immigration and Customs Enforcement (ICE) agents to use force against anti-ICE protesters in Minnesota. The ACLU of Minnesota had filed an appeal of that lower court’s ruling, asking restrictions on use of force to be put back in place.

The appeals court said U.S. District Judge Kate Menendez’s initial ruling restricted ICE agents’ ability to arrest or retaliate against protesters and deemed it overly broad and vague.

The Eighth Circuit also mentioned that videos showed a mix of peaceful and obstructive conduct by protesters, making the enforcement of Menendez’s order impractical and unclear.

Minnesota’s ACLU expressed disappointment over the ruling, indicating it undermines the rights of citizens to safely observe and protest federal actions during ICE operations.
