Courts in West Virginia and Tennessee will review National Guard deployments

Courts in Tennessee and West Virginia will hear arguments on Nov. 3 regarding the legality of President Donald Trump’s deployment of National Guard forces to Memphis and Washington, D.C. West Virginia is one of several states whose Guard forces were deployed to the nation’s capital.

Tennessee Democrats say that Republican Gov. Bill Lee cannot deploy the Tennessee National Guard except for rebellion or invasion. And even in those cases, they say, such a deployment would require approval from the state’s legislature, according to AP News.

The cases come just after U.S. District Court Judge Karin Immergut blocked Trump’s deployment of the National Guard to Portland, Oregon, until at least Nov. 7. Judge Immergut explained that she was still in the “process of diligently reviewing all the evidence,” according to Oregon Public Broadcasting, but indicated that she saw no legitimate legal justification for the deployment at the time.
