Former officer convicted in beating death of Tyre Nichols to be released, granted new trial

Three former Memphis police officers convicted in the 2023 beating death of Tyre Nichols have been granted a new trial. One of the officers, Demetrius Haley, is set to be released on bond as he awaits a new trial, U.S. District Judge Sheryl H. Lipman ruled.

Haley was found guilty on two counts of deprivation of rights resulting in bodily injury and two counts of tampering with a witness, victim or informant. He, along with former officers Tadarrius Bean and Justin Smith, was acquitted on state charges in May.

Two other officers, Desmind Mills Jr. and Emmitt Martin III, pleaded guilty to some charges.

Lipman said that alleged comments made by the trial judge following the case that the Memphis Police Department was “infiltrated” with “gang members” were biased and warrant new trials.
