U.S. District Court Judge Mary Susan McElroy granted states a temporary restraining order prohibiting the Federal Emergency Management Agency (FEMA) from diverting $233 million in FEMA disaster relief funds away from 12 Democratic-leaning U.S. states.

McElroy indicated that the Trump administration’s attempt to seize the funds from those states just days before the end of the fiscal year was plainly illegal. Her ruling ensures that the funds remain available while litigation continues, according to Politico.

Litigant states say that the Trump administration’s attempt to seize the funds is intended to punish states that the administration views as insufficiently loyal to Trump’s anti-immigration agenda, which the Trump-appointed judge noted is also illegal.
