Sen. Lindsey Graham has said he intends to file a lawsuit seeking $500,000 in damages in response to the government’s access to his phone records during the investigation into the events of Jan. 6, 2021. “It bothers the hell out of me and I’m going to sue, and I’m going to create opportunities for others to sue that weren’t in the Senate,” Graham said.
According to recent reviews, eight Republican senators may be eligible to pursue similar claims, each potentially entitled to seek the same amount for records obtained without prior notification. The provision enabling such lawsuits has drawn criticism from some lawmakers, including Rep. Jamie Raskin, D-MD, who characterized it as an unnecessary financial burden on taxpayers.
House Speaker Mike Johnson also expressed concern, calling the measure problematic and stating he plans to support legislative efforts to repeal it.
