Republican Representative Nancy Mace filed a House resolution on Wednesday to expel Democratic Representative LaMonica McIver over alleged assault charges related to a May 9 incident at a Newark ICE detention center. The resolution followed federal charges accusing McIver of assaulting and interfering with ICE officers while attempting to conduct legal congressional oversight at the facility, Delaney Hall. McIver denies the allegations and says she intends to fight them in court.
Mace argued McIver violated her oath by attacking Homeland Security agents and said that if an ordinary citizen were involved in similar conduct, they would likely face arrest.
Mace conceded that expelling a member from the House requires a two-thirds majority vote, referencing the rare precedent set by George Santos’s 2023 removal.
The motion may lead to disciplinary action, but raises debate over legal standards for members and concerns about prosecutorial conduct potentially affecting the caseโs progress.
McIver has denied wrongdoing and shared a comment on social media testifying to her defense.
