A panel of North Carolina judges dismissed a case brought by Gov. Josh Stein against Republican legislative leaders, upholding a law regarding the selection of highway patrol commanders. The judges unanimously upheld a law preventing Stein from choosing the State Highway Patrol commander, stating the law’s provision was constitutional.

State Highway Patrol Commander Col. Freddy Johnson will retain his position until 2030 under the new law.

The judges stated there were “no genuine issues of material fact” and that Stein didn’t prove the law unconstitutional.
