TPS rollback for Venezuelans, Haitians unlawful, judge says

The Trump administration has suffered a legal setback in its attempt to revoke Temporary Protected Status (TPS) for Venezuelans and Haitians living in the U.S. District Judge Edward Chen ruled that Homeland Security Secretary Kristi Noem’s decision to terminate three TPS extensions, including for about 1.1 million people, was unlawful.

Chen found Noem’s action “arbitrary and capricious” and said it exceeded her legal authority because the administration did not conduct the required country condition analyses or involve other federal agencies.
A DHS spokesperson criticized the ruling, saying the TPS program has been “abused, exploited, and politicized” and insisted Noem would pursue all legal options, arguing her actions are needed to protect U.S. citizens’ safety.
