As President-elect Donald Trump prepares to take the oath of office on Monday, Jan. 20, a legal battle is brewing around one of his initiatives. A public interest legal firm, National Security Counselors, will file a lawsuit against the Department of Government Efficiency, also known as DOGE.

What law is DOGE accused of breaking?

In a complaint obtained by the Post, the firm said the DOGE panel is breaking a 1972 law that requires advisory committees to the executive branch to follow certain rules on practices including disclosure and hiring. 

Soon after the election, Trump picked Musk and Ramaswamy to lead DOGE. The department will identify government regulations and spending programs for the White House to cut.

Multiple reports state Ramaswamy is expected to step away from the task force and announce a campaign for Ohio governor as soon as the end of this month.

Ramaswamy hasn’t commented on the report. 

The DOGE group has already hired dozens of employees who are working out of Musk’s SpaceX offices in Washington, D.C. 

The lawsuit claims DOGE does not meet the requirements of a Federal Advisory Committee. That designation is a class of legal structure regulated to ensure the government receives transparent and balanced advice. 

These groups, also called FACAs are legally mandated to have “fairly balanced” representation, keep regular minutes of meetings, allow the public to attend and file a charter with Congress, which are all actions the lawsuit said DOGE hasn’t taken. 

Did Musk respond?

Musk has yet to respond to the planned lawsuit. However, he has been outspoken in the past about what he calls “lawfare.” Musk has described lawsuits designed to disrupt his companies or initiatives as politically motivated.

Supporters of DOGE, including economist Sam Hammond, told the Post, that DOGE is not a formal advisory committee but rather a strategic effort by Trump to streamline government operations. 

Critics of FACA regulations say they impose restrictive requirements that are too broad. 

What about other FACA cases?

In 1993, then-First Lady Hillary Clinton was accused of violating FACA regulations through her leadership of a commission chosen by President Bill Clinton to study health care reform. The accusations claimed she wasn’t an official member of the government.

The U.S. Court of Appeals ruled in her favor, exempting her.

According to the Post, the DOGE lawsuit mentions there are zero federal employees in the department or anyone who represents the perspective of federal employees. 

It also states the White House should be barred from implementing DOGE’s recommendations.

Israel-Hamas ceasefire takes effect in Gaza, halting 15 months of war


After more than 15 months of war between Israel and Hamas, there is a ceasefire that could bring the fighting to an end. A ceasefire agreement took effect at 11:15 a.m. local time Sunday, Jan. 19.

It follows an agreement last week on a multi-phase deal that would include the release of Israeli hostages held by Hamas in Gaza, as well as the withdrawal of Israeli troops from the Gaza Strip.

The deal, which was supposed to go into effect at 8:30 a.m. local time, saw a roughly three-hour delay after Israeli Prime Minister Benjamin Netanyahu demanded that Hamas turn over a list of the names of the initial hostages who would be released Sunday, beginning the first phase of the ceasefire agreement.

Phase one, the first 42 days of the ceasefire, would see Hamas release 33 hostages, the first three of which were released Sunday. In return, Israel released 90 Palestinian prisoners later in the day.

According to the Israeli military, the three hostages are now back in Israel. They have been identified as Romi Gonen, Emily Damari and Doron Steinbrecher.

“The 3 released hostages have arrived at the initial reception point in southern Israel, where they will be reunited with their mothers,” the IDF said in a statement.

Following their release, President Joe Biden spoke to the American people during a press conference on his final full day in office. President-elect Donald Trump will take the oath Monday, Jan. 20.

“The deal that I first put forward last May for the Middle East has finally come to fruition. The ceasefire has gone into effect in Gaza, and today, we’re seeing hostages being released –– three Israeli women held against [their] will in the dark tunnels for 470 days,” Biden said.

Biden said he was “pleased” that his team and Trump’s worked together to make the deal a reality.

“Now it falls on the next administration to help implement this deal,” Biden said. “I was pleased to have our team speak as one voice in the final days. It was both necessary and effective and unprecedented, but success is going to require persistence and continuing support for our friends in the region and the belief in diplomacy backed by deterrence.”

As part of the first phase of the ceasefire deal, Israeli soldiers would move further out from Central Gaza, while displaced Palestinians would move back in.

During phase two, the following 42 days, Hamas would release the remaining hostages in exchange for the release of more Palestinian prisoners and Israeli troops withdrawing from Gaza.

Phase three would be a longer-term ceasefire, involving exchanges of dead bodies between the two sides, the reopening of Gaza’s border crossings, and a plan to rebuild Gaza.

The plan briefly hit a snag after the two sides initially agreed on the terms of the agreement, as Netanyahu held up the required approval vote from his cabinet, alleging Hamas was trying to renege on unspecified key promises. He then scheduled a vote for Friday, Jan. 17, where his cabinet approved the agreement.

The war began when Hamas launched attacks into Israel on Oct. 7, 2023, killing roughly 1,200 people in Israel and taking hundreds more as hostages.

Since then, Israel has launched strikes and invaded Gaza, killing at least 46,000 people based on official Palestinian estimates. A peer-reviewed academic study published earlier this month in medical journal The Lancet suggested that the number could be as high as 64,000.

Israel’s strikes on Hamas targets in the densely populated Gaza Strip led to accusations the country was committing genocide against the Palestinian people, including a report by international human rights group Amnesty International and an ongoing case in the International Court of Justice brought by South Africa.

Israel has repeatedly denied any accusations of genocide, citing its right to self-defense. Both Biden and Secretary of State Antony Blinken have denied Israel’s actions constituted genocide.

TikTok restores service after Trump promises to issue executive order


TikTok restored its U.S. service after the company temporarily shut down access to its app and website for its 170 million American users, shortly before a nationwide ban on the platform went into effect at midnight Sunday, Jan. 19. TikTok’s announcement comes after President-elect Donald Trump earlier in the day said he would issue an executive order on his first day in office –– Monday, Jan. 20 –– giving the platform’s China-based parent company, ByteDance, more time to work out a deal.

“I will issue an executive order on Monday to extend the period of time before the law’s prohibitions take effect, so that we can make a deal to protect our national security. The order will also confirm that there will be no liability for any company that helped keep TikTok from going dark before my order,” Trump said.
 
“Americans deserve to see our exciting Inauguration on Monday, as well as other events and conversations.”

Trump added he would like the United States to have a 50% ownership position in a joint venture to keep the video-sharing app active. The president-elect said, “My initial thought is a joint venture between the current owners and/or new owners whereby the U.S. gets a 50% ownership in a joint venture set up between the U.S. and whichever purchase we so choose.”

Following Trump’s announcement, TikTok issued a statement saying it would be restoring service to the 170 million Americans who use its platform.

“In agreement with our service providers, TikTok is in the process of restoring service. We thank President Trump for providing the necessary clarity and assurance to our service providers that they will face no penalties providing TikTok to over 170 million Americans and allowing over 7 million small businesses to thrive,” TikTok said.

“It’s a strong stand for the First Amendment and against arbitrary censorship. We will work with President Trump on a long-term solution that keeps TikTok in the United States.”

Despite President Joe Biden signaling that he would not enforce the ban, and would instead leave the decision to President-elect Trump, the platform shut itself down to avoid the risk of potentially heavy fines for hosting access to the platform in the U.S.

During the shutdown, a notice in the app directly credited President-elect Trump, saying “We are fortunate that President Trump has indicated that he will work with us on a solution to reinstate TikTok once he takes office.”

TikTok going dark for its American users was the culmination of a years-long bipartisan push to ban the app. During Trump’s first term in 2020, he threatened to ban the app over its ties to the Chinese government. 

In 2024, Biden signed the law that put the current ban in place, which gave the app’s owners until Sunday to either shut down or sell to a buyer not defined as a “foreign adversary of the United States.”

Rep. Mike Gallagher, R-Wis., introduced the original bill and it passed with veto-proof majorities and support from both Democrats and Republicans.

But as the ban neared, multiple lawmakers changed their stances. Sen. Cory Booker, D-N.J., who initially voted for the ban, joined Sen. Ed Markey, D-Mass., and Rep. Ro Khanna, D-Calif., in their push for a last-ditch bill to rescind the ban.

Despite Trump saying it was likely he would work to develop a solution that would restore Americans’ access to the app, Republican Sens. Tom Cotton, R-Ark., and Pete Ricketts, R-Neb., blocked the bill from advancing by objecting to it.

The Supreme Court unanimously rejected TikTok’s challenge to the ban, saying that the national security concerns underpinning the law took priority over its role as a speech platform. The court ruled that the ban did not infringe on the First Amendment rights of the company or its users.

Trump has signaled that tech issues, including the future of TikTok, are top priorities for his incoming administration. Executives from the largest apps and tech companies will be present for his inauguration on Monday, Jan. 20, including TikTok CEO Shou Zi Chew.

FBI closes diversity and inclusion office, Trump weighs in


The Federal Bureau of Investigation (FBI) confirmed it closed its Office of Diversity and Inclusion (ODI) in December. The announcement comes less than a month before President-elect Donald Trump assumes office for a second term.

“In recent weeks, the FBI took steps to close the Office of Diversity and Inclusion (ODI), effective by December 2024,” the agency told Fox News in a statement Thursday, Jan. 17.

Now, Trump is weighing in on the decision. In a post on his social media platform Truth Social, Trump wrote, “We demand that the FBI preserve and retain all records, documents, and information on the now closing DEI office—never should have been opened and, if it was, should have closed long ago. Why is it that they’re closing one day before the inauguration of a new administration? The reason is, corruption!”

In September 2020, during his first term in the White House, then-President Trump signed an executive order titled “Combating Race and Sex Stereotyping,” which stated, “It shall be the policy of the United States not to promote race or sex stereotyping or scapegoating in the federal workforce or in the uniformed services.”

The order banned certain diversity, equity and inclusion (DEI) training. It also prohibited federal agencies and contractors from conducting training that promoted certain concepts. They include the idea that one race or sex is inherently superior to another or that the United States is fundamentally racist or sexist.

After President Joe Biden took office in January 2021, he quickly revoked Trump’s executive order and signed a new one titled “Advancing Racial Equity and Support for Underserved Communities Through the Federal Government.” The new order aimed to promote diversity and inclusion in federal agencies rather than restrict them.

The FBI’s announcement comes after Sen. Marsha Blackburn, R-Tenn., wrote a letter to outgoing FBI Director Christopher Wray shortly after a terrorist attack in New Orleans on New Year’s Day that left 14 people dead.

In the letter, Blackburn accuses Wray of settling for low-quality candidates to satisfy DEI mandates. She says it compromises national security.

“Put simply, your focus on woke DEI initiatives at the FBI has endangered our national security and the lives of all Americans,” Blackburn’s letter states. “Americans now feel increasingly unsafe because of incidents like the January 1 terror attack, and the FBI’s prioritization of diversity over competence shows that their concerns are well-founded.”

Just a few months ago on the campaign trail, Trump vowed to end DEI policies at universities. He claimed the practices are discriminatory. He threatened to impose fines on colleges equal to their entire endowment if they continued implementing DEI initiatives.

Alabama passed a law last year barring state institutions from using public funds for DEI initiatives. It led to the University of Alabama and Auburn University closing their DEI offices.

Iowa, Texas and Utah have all banned DEI initiatives at universities.

In the private sector, major companies have also recently announced plans to roll back their DEI efforts. They include Walmart, John Deere, Molson Coors, Lowe’s, Meta and Tractor Supply.

Wray announced he will resign from his position, despite having three years left in his term, when Trump takes office.

Trump has tapped Kash Patel to lead the agency, pending Senate confirmation.

Trump holds ‘very good’ phone call with Xi, China sending VP to inauguration

President Xi Jinping echoed Trump’s sentiments about the call, saying that both leaders expressed “hope for greater progress in U.S.-China relations,” according to Reuters.

While Trump had initially invited Xi to attend his inauguration, the Chinese Foreign Ministry confirmed in a media statement that Vice President Han Zheng would represent China at the event.

The statement read, “We stand ready to work with the new U.S. government to enhance dialogue and communication … and find the right way for the two countries to get along with each other.”

During Trump’s first term in office, he traveled to China and was greeted by Xi Jinping, who provided Trump with a rare tour of the Forbidden City. Xi also visited Mar-a-Lago in 2017 for a meeting with Trump, which remains his last visit to the United States.

Google won’t add fact-checking despite new European Union law: Report

Google is pushing back against the European Union by refusing to add fact-checking, despite the requirements of a new European Union law. Axios obtained a letter that Google Global Affairs President Ken Walker sent to Renate Nikolay, the deputy director general of content and technology at the EU.

In the letter, Walker said Google would “pull out of all fact-checking commitments in the code” before the rules become law and called it not “appropriate” or “effective” for their services.

Google has never included fact-checking as part of its content moderation practices, while the proposed code would obligate Google to display fact-check results alongside its search results and YouTube videos and incorporate fact-checking into its ranking algorithms.

According to Axios, Walker defended Google’s existing content moderation strategy in the letter, citing its effectiveness during the “unprecedented cycle of global elections.”

He also mentioned a new feature on YouTube that enables some users to add notes to videos, which is similar to X’s community notes feature and a new program Meta announced last week.

Meta was also one of 40 online platforms that signed the new EU fact-checking code, even though it recently dropped fact-checkers in the U.S.

X, previously known as Twitter, also signed the code but reversed course after Elon Musk bought the platform.

It’s not clear whether all the code’s requirements will be formalized into official rules under Europe’s Digital Services Act, which regulates digital platforms and services.

But EU lawmakers have been discussing with the companies that signed about the commitments they’ll agree to follow.

Trump moves inauguration inside due to cold temperatures

President-elect Donald Trump announced his inauguration will be held inside the Capitol rotunda due to the extreme cold temperatures forecast for Washington, D.C., on Monday, Jan. 20. The area has had consistent freezing conditions throughout the month of January. There is also still snow on the ground from the storm on Jan. 6, which dumped about a foot in Washington and Maryland.

Trump said Capital One Arena in downtown Washington, D.C., will host a viewing party. Trump said he also plans to join the crowd for the inaugural parade after the ceremony.

The president-elect said all other events will go on as planned, including the victory rally at 3 p.m. on Sunday, Jan. 19 at Capitol One Arena and the three inaugural balls on Monday night, Jan. 20. 

Capital One Arena is home to the Washington Capitals (NHL) and Wizards (NBA). It has a 20,000-seat capacity.

This isn’t the first time an inauguration has been held in the Capitol rotunda. Former President Ronald Reagan’s second swearing-in was held there in 1985, also due to cold weather.

The Israeli security cabinet on Friday, Jan. 17, approved a Gaza ceasefire deal with Hamas. The move came just hours after Prime Minister Benjamin Netanyahu announced the two countries reached an agreement to return hostages.

The ceasefire agreement will take effect Sunday.

CNN reported Netanyahu told his security cabinet that he received guarantees from negotiators that the United States would back Israel, returning to war, if future talks with Hamas break down.

Under the three-phase ceasefire agreement, fighting will stop in Gaza for 42 days. Hundreds of Palestinians and 33 Israeli hostages, including Americans, will be freed during the first phase.

By day 16 of the 42-day ceasefire, negotiators will begin talks on phase two of the deal, which would see the release of all remaining hostages, including Israeli male soldiers.

In addition, all Israeli troops will withdraw from Gaza, allowing many Palestinians to return to what remains of their homes.

The ceasefire will end more than a year of fighting between Israel and Hamas. The conflict began on Oct. 7, 2023, when Hamas militants attacked a music festival in Israel, killing more than 1,000 civilians.

The ensuing war has claimed tens of thousands of lives after Netanyahu vowed to crush Hamas.

The U.S. Supreme Court unanimously upheld the law that has commonly been referred to as the TikTok ban. The law requires the short-form video app’s parent company, ByteDance, to sell it by Sunday, Jan. 19, or be shut down in the United States.

The justices heard a last-minute appeal during the week of Jan. 6, in which the company and its users argued the law infringes on their First Amendment rights. The justices disagreed.

“It is not clear that the Act itself directly regulates protected expressive activity, or conduct with an expressive component,” the justices wrote in the opinion. “Indeed, the Act does not regulate the creator petitioners at all. And it directly regulates ByteDance Ltd. and TikTok Inc. only through the divestiture requirement.”

The law is officially called the Protecting Americans from Foreign Adversary Controlled Applications Act. It was approved by Congress on a bipartisan basis in 2024. It prohibits distributing, maintaining or providing internet hosting services for an app that’s under the control of a foreign adversary. In this case, the app is TikTok, which is owned by ByteDance, a company based in China, the foreign adversary.

TikTok has announced that it plans to shut down the app for American users. The company said access will be disabled, and that users who open it will see a pop-up message directing them to a website with information about the law. TikTok said this will allow them to quickly bring the app back online if the law is lifted, or a qualified sale of the company is approved.

Multiple news outlets reported that President Joe Biden will not enforce the ban and will leave the decision to the Trump administration. There is an option to implement a 90-day extension if the White House determines progress is being made on finding a buyer outside China. President-elect Donald Trump said he wants to make a deal to save TikTok.

Apple and Google are expected to remove TikTok from their app stores to avoid liability. The law has a penalty of $5,000 per user for any company that allows downloads or updates. If every current user updated the app, the collective fine to the companies that allowed it would be $850 billion.

His spokesperson, Fabien Levy, said the two will discuss “New Yorkers’ priorities.”

“The mayor looks forward to having a productive conversation with the incoming president on how we can move our city and country forward,” Levy posted on X.

Adams previously said he wants to work with the incoming Trump administration, especially on immigration and border security after his city has struggled to address an influx of migrants.

The mayor’s office said last week that more than 229,000 migrants have arrived in New York City seeking city services since the spring of 2022.

He met with incoming border czar Tom Homan in December 2024.

A few days later that meeting, Trump suggested he would consider pardoning Adams.

“Yeah, I would, I think that he was treated pretty unfairly,” Trump said at a news conference Dec. 16.

Adams is set to go to trial in April on bribery and wire fraud charges, which were part of an alleged scheme that spanned nearly 10 years.

Trump’s inauguration is on Monday, Jan. 20.

Adams told NY1 News last week he would like to attend the event. There’s no official word on whether he’ll be there.
