DeSantis details proposals for Florida’s role in Trump’s immigration plan

Florida Gov. Ron DeSantis outlined several proposals for how the state can support incoming President Donald Trump’s immigration plan, which includes mass deportations. The proposals come just a few days after DeSantis announced his intention to call a special session to address illegal immigration.

DeSantis proposed giving local and state law enforcement full authority to enforce immigration laws. It would include the power to arrest and detain immigrants who are in the country illegally. He also suggested appointing a state immigration officer to oversee coordination efforts with federal immigration authorities.

Additionally, the Florida governor recommended implementing a criminal penalty for anyone entering the state illegally. Currently, illegal entry into the United States is only a federal crime.

“We should do this so that we have an ability to hold them accountable in ways,” DeSantis said. “And my thing on this when people say, ‘Oh, well, deport the criminals.’ The problem with that is if somebody is here and they’re in a gang and they haven’t committed a crime yet, are you just supposed to sit there and wait until somebody is victimized? No, your illegal entry into our state was a crime. We get that on the books, and then we send you back home where you belong. So we need to do that.”

DeSantis expressed skepticism that Congress would pass immigration reform. He said it would be up to state leaders to proactively assist the federal government when Trump returns to the White House on Monday, Jan. 20.

However, some Florida state lawmakers have said they are not interested in a special session, complicating if and when the session will be held.

Meanwhile, other state leaders are either preparing to align with Trump’s immigration plan or outlining a defense against mass deportations.

Gov. Newsom convenes special session in California

California Gov. Gavin Newsom convened a “Trump-proofing” special session of the state legislature.

On Monday, Jan. 13, California State Sen. Scott Wiener announced amended legislation allocating $25 million for legal aid to those at risk of deportation. Lawmakers also proposed setting aside $25 million for state and local lawsuits against the Trump administration.

“Senate Democrats are particularly proud to provide funding for providers of legal aid services, which know our communities’ needs best and are best positioned to defend at scale the millions of individuals and families that will be impacted by the incoming administration’s extreme agenda,” Wiener said in a statement.

Idaho bill targets undocumented immigrants

In Idaho, lawmakers introduced a bill Tuesday, Jan. 14, that, if passed, would allow local law enforcement to arrest and charge migrants who are in the country illegally. ACLU officials have stated that they will challenge the legislation if it becomes law. They argue that it is unconstitutional and could lead to racial profiling.

Gov. Hochul, Mayor Adams address immigration in New York

In New York, Gov. Kathy Hochul reaffirmed her commitment to protecting migrants working and living in the country for years. However, she stated that immigrants living in the country illegally who commit crimes should be deported.

“If someone breaks the law, I’ll be the first one to call up [U.S. Immigration and Customs Enforcement] and say, ‘Get them out of here,’” Hochul said.

New York City Mayor Eric Adams echoed a similar sentiment. After meeting with Trump’s incoming “border czar,” Tom Homan, last month, Adams said they both want to get criminal migrants off the streets of New York.

“We’re going to protect the rights of immigrants in this city that are hard-working, giving back to this city in a real way,” Adams said at the time. “We’re not going to be a safe haven for those that commit repeated violent crimes against innocent migrants, immigrants and long-standing New Yorkers.”

Texas offers land for detention facilities

In Texas, Gov. Greg Abbott’s administration has offered land to the Trump administration where it can build detention facilities and carry out its mass deportations.

Homan, who Trump tapped to help facilitate the deportations, has said the federal government has a “zero tolerance” policy when it comes to unlawful migration. He also emphasized that sanctuary cities and states undermine the rule of law. Homan warned Democratic lawmakers in November “to get the hell out of the way” if they oppose Trump’s deportation plans.

Trump has stated that he plans to implement his mass deportation plan on his first day in office. The inauguration will take place Monday.

Ted Cruz introduces ‘No Tax on Tips’ bill echoing Trump campaign promise

Sen. Ted Cruz, R-Texas, introduced a bill Thursday, Jan. 16, that would make one of President-elect Donald Trump’s major policy proposals a reality: the No Tax on Tips Act. Cruz reintroduced a bill similar to the one he proposed last July.

This time, however, the bill has the support of Nevada’s two Democratic senators, making it a bipartisan proposal.

While the bill would change the federal tax code to allow people to claim a 100% deduction on income collected via tips from federal income tax, it would not exempt the money from being factored into other taxes, such as the payroll tax that gets withheld from workers’ paychecks.

Cruz said that “this bill is an important step to ensure we are addressing the economic needs of working Americans.”

Trump introduced the proposal on the campaign trail last year. His Democratic opponent, Vice President Kamala Harris, quickly adopted it.

But while Republicans, many Democrats and labor unions support the idea, economists aren’t sure it will have a positive effect.

One issue is that not many workers earn tips. Additionally, many of those who do don’t make enough to pay any federal income tax.

An analysis last summer by the Yale Budget Lab found that only 2.5% of American workers are in jobs where they earn tips. And that more than a third of tipped workers had incomes low enough to avoid paying any income tax.

Economists also raise questions about the fairness of promoting tip-based jobs like serving and bartending over other similar-paying jobs that don’t collect tips.

Conservative economist and former Republican-appointed Congressional Budget Office Director Douglas Holtz-Eakin criticized the proposals when they first gained traction. He wrote, “There is no particular reason to treat one kind of labor income differently than another,” and that “It is not an effective way to promote work.”

Should a “No Tax on Tips” bill pass, restaurant owners may hope it stops efforts to end the practice of tipping by evening out the minimum wage. The federal minimum wage for tipped workers is more than 70% lower than for non-tipped workers.

Eight states and the District of Columbia have passed laws eliminating or phasing out the gap between tipped and non-tipped workers in their state minimum wages.

However, a bill eliminating taxes on tips could lead workers to push for opportunities to make additional tax-free income.

John Deere blames politics for FTC lawsuit on farmers’ right to repair

The Federal Trade Commission has filed a lawsuit against John Deere, accusing it of boosting profits by forcing farmers to use authorized dealers for repairs. But the tractor giant called the lawsuit “meritless,” and pointed out it was filed in the final days of the outgoing Biden administration.

The FTC, along with Illinois and Minnesota, claimed Deere prevents farmers from being able to repair their own equipment or use independent shops. Instead, they say Deere forces owners to use authorized dealers, which increases farmers’ costs while the company makes billions in profit.

How does John Deere control who repairs its equipment?

“What they say John Deere is doing is that they’ve designed the equipment to require the use of John Deere’s service advisor software tool to complete the repairs for a certain number of repairs, and that tool is completely restricted to dealerships,” right-to-repair advocate Nathan Proctor told Straight Arrow News.

Large farm equipment, like tractors and combines, are increasingly built to be more reliant on computer systems. Equipment owners claim this makes it nearly impossible to diagnose and ultimately repair issues without Deere’s help.

“If you’re a farmer and your equipment breaks, the only place you can take it where you know they’re going to have all of the necessary parts, tools and information to complete the job is the dealership, and that is by design,” said Proctor, who serves as the senior director for the Public Interest Research Group’s Campaign for the Right to Repair.

How did John Deere respond?

“The complaint is based on flagrant misrepresentations of the facts and fatally flawed legal theories, and it punishes innovation and procompetitive product design,” Deere wrote in a statement.

Meanwhile, the company said it supports customers’ abilities to maintain and repair their own machines. The company announced earlier this week it was launching “additional self-repair capabilities.”

What’s in the FTC’s lawsuit?

In its lawsuit, the FTC said Deere’s Production and Precision Agriculture segment, which includes large tractors and combines, brought in $7 billion in operating profit in 2023.

“Unfair repair restrictions can mean farmers face unnecessary delays during tight planting and harvest windows. In rural communities, the restrictions can sometimes mean that farmers need to drive hours just to get their equipment fixed,” FTC chairperson Lina Khan said in a statement.

The commission voted 3-2 to bring the lawsuit, with both Republican commissioners dissenting. Notably, one of those is President-elect Donald Trump’s pick to become the next FTC chair, Commissioner Andrew Ferguson.

What’s next for the lawsuit, and for repairing John Deere equipment?

Deere seized on comments made by Ferguson, who said the lawsuit “appears to be the result of brazen partisanship,” “lends to the suit the stench of partisan motivation,” and appears “taken in haste to beat President Trump into office.”

“We simply do not have the evidence to file this Complaint with any real confidence of our ultimate chance of success,” Ferguson said.

While Deere continues to contend the FTC is relying on “inaccurate information and assumptions,” Proctor and other right-to-repair advocates hope for a simple remedy to the problem.

“There’s a software tool that you need to complete the full range of repairs,” Proctor said. “That’s the software tool that should be available to independent mechanics and to farmers.”

Right-to-repair extends beyond tractors and big machinery. Advocates in the space have called for consumer tech manufacturers, like Apple, to make it easier to repair devices. In 2022, the FTC also took action against Harley-Davidson and Weber grills.

Deere has been at least for the last six years, has come out with a whole number of partial steps towards, hey, we’ll let you do this configuration now. Hey, we have a new you can buy a manual. It’s a little bit easier to get the manual. But at the end of the day, there are repairs where the only possible way to conduct or repeat or, you know, complete the repair is by plugging in a dealership computer. There is no option.

The agency claims by pushing farmers to authorized dealers, farmers are then sold name-brand replacement parts, which bolster Deere’s profits.

Their whole livelihood depends on the ability to operate equipment in a timely way, and when that equipment is only fixable by a dealership. And there’s a lot fewer dealerships now, and they’re consolidating, and everybody in your area is using the same kind of equipment at the same time of year, it creates these huge bottlenecks.

The commission voted 3 to 2 to bring the lawsuit, with both Republican commissioners dissenting.

While Deere continues to contend the FTC is relying on “inaccurate information and assumptions,” Proctor says there’s a simple solution to the accusations Deere faces.

‘Virtue signaling’: Zuckerberg responds to Facebook user exodus reports

Some media reports suggest that Meta’s new policies are prompting boycotts and a potential mass exodus from Facebook and Instagram. Other reports claim Meta’s recent decisions have caused Google searches for “delete Facebook” to soar.

Both reports, however, have limitations in their data. The report about users searching “how to delete Facebook” relies on Google Trends data, which does not provide actual search volume numbers. As a result, it’s unclear how many people searched for ways to delete their Facebook accounts.

NBC News’ report, citing users calling for a boycott, is based on a review of what NBC News described as “hundreds of posts and comments.” This sample size is small compared to Meta’s more than 3 billion active users.

Meta CEO Mark Zuckerberg responded to the idea that people might leave over the company’s new policies in a message on Instagram’s Threads app.

“I’m counting on these changes actually making our platforms better,” Zuckerberg said. “I think Community Notes will be more effective than fact-checkers, reducing the number of people whose accounts get mistakenly banned is good, people want to be able to discuss civic topics and make arguments that are in the mainstream of political discourse, etc. Some people may leave our platforms for virtue signaling, but I think the vast majority and many new users will find that these changes make the products better.”

Zuckerberg’s recent policy changes at Meta have also raised questions from other countries about whether the changes, already implemented in the U.S., will soon be applied elsewhere.

The changes include ending fact-checking in favor of allowing users to add Community Notes to posts and loosening restrictions on certain topics, such as gender and sexual identity, which were previously not allowed for discussion on Facebook or Instagram.

Conservatives have praised these changes as a way to reduce regulations on free speech. However, some on the political left have criticized the changes, warning that they could lead to the spread of disinformation.

In Brazil, where the government is currently led by President Lula da Silva, officials have asked Meta if its newly announced policies will apply to the country. Meta responded that fact-checking will only be phased out in the U.S. for now, as the company tests its Community Notes system.

Meta also confirmed that looser restrictions on controversial topics, like debates on sexual identities, will apply in Brazil to allow for “broader conversation on topics that are part of current discussions in society.”

Brazil’s attorney general and other officials, upset over Meta’s decisions, have scheduled a hearing to discuss their next steps and whether the new policy violates the country’s human rights laws. Brazilian Communications Minister Sidonio Palmeira has said Meta’s new measures “violate fundamental rights and national sovereignty, promoting a digital Wild West.”

Zuckerberg has defended his decisions, arguing that the company’s fact-checkers were politically biased and led to excessive censorship. He also stated that Meta will continue to remove threats and content that incites violence.

The date of Brazil’s hearing has not yet been announced.

Commanders’ Gonzalez is among athletes managing OCD on grand stage


When Washington Commanders placekicker Zane Gonzalez kicked a 37-yard field goal Sunday, Jan. 12, to give his team its first playoff win since the 2005 season, it wasn’t just the “doink” off the uprights NBC cameras captured. As Gonzalez readied to send his team into the divisional round, a national audience was brought into his preparation, with many not fully understanding what they were watching.

From adjusting his socks to touching his hair repeatedly, the Sunday Night Football commentators and viewers at home saw what the 29-year-old Texas native has been dealing with most of his life — a condition known as obsessive-compulsive disorder or OCD.  

Though Gonzalez has been shown on camera before when going through his pre-kick routine, with him playing in an NFL postseason game, more eyes were on him than ever before. This gave a big platform for the condition that affects millions of people across the country.

The Mayo Clinic describes OCD as a disorder that “features a pattern of unwanted thoughts and fears known as obsessions. These obsessions lead you to do repetitive behaviors, also called compulsions. These obsessions and compulsions get in the way of daily activities and cause a lot of distress.”

According to the International OCD Foundation, about 1 in 40 U.S. adults has OCD or will develop it at some point in their lives. That’s approximately 8.2 million people.

The foundation says, on average, 1 in 100 children have OCD. Gonzalez has been dealing with OCD since he was a child. The football star began to open up about managing the condition when he was a freshman at Arizona State.

After breaking an NCAA record for field goals in a career (he was nicknamed “Legatron” by ASU fans after all), the Sun Devils kicker became an NFL player when he was selected by the Cleveland Browns in the 2017 draft.

He had to wait for that moment though, it was the seventh round and Gonzalez was the 224th pick. ESPN reported that year, “It’s possible Gonzalez slipped down the draft board due to his honesty about his obsessive-compulsive disorder.”

A few months after the draft, Gonzalez told the network, as a football player with OCD, “It makes you a perfectionist and more detail-oriented. Off the field, it’s a pain in the butt.”

No matter the round he was drafted, Gonzalez was in the NFL and he pressed on as his career took him to Arizona, Detroit, Charlotte, San Francisco and, just this past November, to Washington, mere weeks before his game-winning kick.

In 2021, he spoke to the Charlotte Observer about coping with OCD, saying, “It affected me a lot more as a young kid … It’s just little thoughts, little funny habits that I do … specifically, sometimes I rinse my hands before kicks … And I was kind of curious about that.”

He continued, “But that’s one of the most common things that people with OCD do. It instantly makes you just feel relieved. I don’t know why, if it’s just a placebo effect.”

“It’s not something I love having. But it just is what it is, and I’ve learned to deal with it,” he said. 

The NFL kicker joins several other pro athletes speaking publicly about their OCD experiences.

As a young adult, New Zealand Olympian track cyclist Sam Dakin first began noticing OCD symptoms in 2018, just a few years before competing in his first Olympic games in Tokyo.

Shortly after returning home from the games, he spoke to the Mental Health Foundation of New Zealand about his OCD struggles.

“I was 22 years old … and then woke up one day and just … Boom. There’s just one thought on repeat,” Dakin said. “It started for an hour a day and then eventually just got worse and worse. And then it was 16 hours a day and I could only escape it when I slept, which was just horrific.”

On Jan. 5, Dakin sat down with The Good Day Matrix podcast about how an online community helped him in dealing with the condition.

“I started just scrolling the internet and Googling this thing that was going on in my head, and eventually one day I was on Reddit and I found this, like, feed of pure OCD, and these people just described exactly what I was feeling,” Dakin said.

“It was just like this relief. I was like I’m not alone, other people have gone through this. It’s actually relatively normal but not many people have talked about it.”

Like Gonzalez, Dakin said he’s not shy about speaking about OCD, and hopes his words can help someone else going through what he did.

“I was just like, man, this can help so many people, and I feel comfortable to talk about it,” Dakin said. “And if I can talk about it more then it’ll help others, and it’s just kind of grown from there really. I have tried to do it in a way that’s really me and really organic and not shoving it down people’s faces.”

Millie Farrow, a United Kingdom pro soccer player, currently playing with Sydney FC, also knows what it’s like to battle OCD while living out your childhood dreams.

She told The New York Times in 2023, “It is a very strange place to be — being controlled by a thought in your head.”

Farrow told The Times she would see someone she described as “contaminated” touching a certain surface and would “be assessing it, analyzing it.”

Farrow said with a diagnosis and therapy starting at age 14, she has been able to get a handle on her OCD, saying, “It is something I will have for the length of my life, but it can be dealt with, and can be under control. That’s the place I’m in now.”

Now, as a professional soccer player, she said, “I’m so glad I didn’t give up.”

David Beckham, one of the most famous soccer stars to play the game, opened up in a 2023 Netflix documentary series about how OCD affects his life in retirement. He used humor to discuss his symptoms during an appearance on “Jimmy Kimmel Live!” to promote the series.

“[My wife] Victoria always jokes because when we have our friends around for dinner or drinks, you know, I start turning like lights off and cleaning the candles,” Beckham said.

For the millions dealing with OCD, it may not be humor that gets them through, but finding someone to rely on.

Dakin told the Mental Health Foundation of New Zealand, that his advice to those struggling with OCD is to “find someone that you trust and you feel you can lean on, and in turn they’ll understand and they’ll want to be there to help you.”

For others, it was that game-winning kick that made them feel a sense of connection — as PGA Tour and SiriusXM host Jeff Eisenband wrote on X, “As someone who has dealt with OCD most of my life, I have such immense respect for Zane Gonzalez being able to perform in the clutch like this. Hate seeing people try to drag him for it.”

Zane Gonzalez’s wife Lizzy also wanted to send a message to those who poked fun at her husband’s pre-kick routine, without knowing the full story. She posted a TikTok video using the “Scram! Leave her alone!” viral meme.

Last year was a year of celebration for Zane Gonzalez. He got married last April and the couple then welcomed their first child in December. Now, Gonzalez is looking for the good times to continue in 2025.

Next up, Washington meets Detroit in the NFL’s divisional round, and after the headlines his wild card kick made, he’ll probably have a few new fans rooting for him in the games to come.

Reports indicated Trump warmed to TikTok after his campaign saw a surge in popularity on the app during the 2024 election.

Incoming National Security Adviser Mike Waltz said, “TikTok itself is a fantastic platform. We’re going to find a way to preserve it but protect people’s data, and that’s the deal that will be in front of us.”

Outgoing President Joe Biden’s administration also explored ways to soften the ban’s impact during its final days. Officials reportedly considered options to avoid an immediate shutdown. This includes measures to allow the app to continue operating temporarily while ensuring compliance with the law.

TikTok challenged the divestiture requirement in court, arguing it violates the First Amendment right to free speech.

The Supreme Court heard arguments last week and appeared poised to uphold the law. Trump is reportedly considering an executive order to postpone the ban for 60-90 days to allow further negotiations.

Biden’s administration has not committed to blocking the ban but delayed immediate enforcement. Biden’s allies, including lawmakers like Rep. Ro Khanna, D-Calif., called on the White House to extend the timeline.

“I’m hopeful that President Biden will listen to the millions of voices who don’t want the lights to go out on this app,” Khanna said.

Congressional supporters of the ban argued TikTok’s ties to Beijing pose risks to user data and content control.

Chief Justice John Roberts, during Supreme Court arguments, pointed to Congress’ finding that TikTok’s parent company is subject to Chinese laws, saying, “So are we supposed to ignore the fact that the ultimate parent is, in fact, subject to doing intelligence work for the Chinese government?”

Under the three-phase ceasefire agreement, fighting will stop in Gaza for 42 days. Hamas will free 33 Israeli hostages, including two Americans and hundreds of Palestinian prisoners, during the first phase effective Sunday, Jan. 19. 

The remainder of the hostages, including Israeli male soldiers, are to be released during the second phase. Hamas said it will not release the remaining captives without a lasting ceasefire and a full Israeli withdrawal. 

Israeli troops will pull back to the edges of Gaza and many Palestinians will be able to return to what remains of their homes — something many people took to the streets to celebrate. Israel is also set to allow a flood of humanitarian aid into the region. 

The Associated Press reported Thursday, Jan. 16, that Egyptian, Qatari and American mediators will meet in Cairo on Thursday for talks on implementing the deal. 

On Truth Social, Trump said his administration will work closely with Israel to make sure Gaza never becomes a “terrorist safe haven” again.

Village People to perform at Trump’s inauguration amid mixed reactions

The Village People will bring a disco twist to the 2025 inauguration stage. The iconic group, known for their hit “Y.M.C.A.,” confirmed they will perform at President-elect Donald Trump’s inauguration on Monday, Jan. 20.

The group’s music has been a staple at Trump’s rallies since 2020. His signature dance to “Y.M.C.A.” often energizes the crowd, making the song a frequent rally highlight.

On Monday, Jan. 13, the Village People announced their decision to participate in the inauguration. They acknowledged that their choice might stir controversy.

“Our song ‘Y.M.C.A.’ is a global anthem that hopefully helps bring the country together after a tumultuous and divided campaign,” the group wrote on Facebook. “We believe it’s time to unite through music, which is why we will perform at various events for the 2025 inauguration of Donald J. Trump.”

Mixed reactions

While some fans supported their decision, others expressed disappointment.

“This decision feels like a betrayal to the very people who have supported and celebrated your work for decades,” one Facebook user wrote. “Performing for a president-elect whose policies and rhetoric oppose equality and inclusion is not just disappointing—it’s harmful.”

Another user shared a different perspective: “It’s not about left or right, liberals or conservatives, or Democrats and Republicans. It’s about bringing people together through your music. I hope this performance brings a brighter and more prosperous New Year for all.”

This isn’t the first time the group has faced criticism over their connection to Trump.

Lead singer and lyricist Victor Willis addressed the controversy in a December Facebook post. He explained why he allowed Trump to use “Y.M.C.A.” at rallies despite initially asking him to stop.

Willis described the complaints as a nuisance but noted that the Trump campaign legally obtained a “political use license” for the song. He ultimately allowed it, saying he noticed Trump “genuinely having fun” with the music.

The Village People join Carrie Underwood on the list of performers for Monday’s events.

And now, the Village People announced Monday they accepted an invitation to participate in Monday’s events, acknowledging it may not sit well with everyone.

The group defended their choice, emphasizing that music transcends politics. Part of their post reads, “Our song Y.M.C.A. is a global anthem that hopefully helps bring the country together after a tumultuous and divided campaign where our preferred candidate lost. Therefore, we believe it’s now time to bring the country together with music which is why VILLAGE PEOPLE will be performing at various events as part of the 2025 Inauguration of Donald J. Trump.”

Reaction to the announcement has been mixed. One Facebook user shared their disappointment, commenting in part, “This decision feels like a betrayal to the very people who have supported and celebrated your work for decades. Performing at events for a president-elect whose policies and rhetoric stand in opposition to equality and inclusion is not just disappointing—it’s harmful.”

This isn’t the first time the group has faced backlash over their connection to Trump.

Victor Willis – the lead singer and lyricist – posted on Facebook last December explaining why he allowed Trump to continue using “Y-M-C-A” at rallies.

Willis originally asked Trump to stop, citing the issue as a nuisance due to complaints from fans. However, since the campaign had a “political use license,” Willis ultimately let it stand after saying he saw how much fun Trump was having with the song.

The Village People now join Carrie Underwood as part of Monday’s inauguration lineup.

President-elect Donald Trump is reportedly working with New Jersey Republican Rep. Jeff Van Drew on an executive order aimed at stopping the construction of new wind turbines off the east coast. Van Drew, whose congressional district includes well-known seaside destinations such as Long Beach Island, Cape May and Atlantic City, announced Monday, Jan. 13, that he has been collaborating closely with Trump on the measure.

According to Van Drew, longer-term plans for permanent restrictions on offshore wind projects have also been discussed. The congressman indicated the executive order could be finalized within months of Trump’s inauguration.

“This executive order is just the beginning,” Van Drew said. “We will fight tooth and nail to prevent this offshore wind catastrophe from wreaking havoc on the hardworking people who call our coastal towns home.”

The Biden administration approved New Jersey’s first offshore wind project in July 2024, a 200-turbine initiative by Atlantic Shores Offshore Wind. However, the project, which is visible from Long Beach Island, has faced opposition from residents since before receiving federal approval.

Trump has long opposed wind energy, often criticizing it as inefficient and visually unappealing. He has also attributed wind turbine operations to bird and marine life deaths.

During a press conference on Jan. 7, Trump reiterated his stance, stating that he plans to halt new offshore wind energy projects during his second term. This follows his campaign promise to end such developments on the first day of his administration.

FDA bans Red No. 3 in food and drinks due to potential cancer risk

The U.S. Food and Drug Administration is taking steps to remove the synthetic dye Red No. 3 from food and beverages, decades after it was linked to cancer risks. Originally approved in 1907, the additive has been a staple in many popular foods, including candy, cereal, cherries and dietary supplements.

Though the research prompted concern, the FDA did not take immediate action, citing the effects on humans were not shown. However, in recent years, advocacy groups and lawmakers have pressed for stronger action against the dye, prompting the FDA to revisit its stance.

On Wednesday, Jan. 15, the FDA announced plans to remove Red No. 3 from the list of approved color additives, citing the Delaney clause, a law banning any food additives known to cause cancer in both people and animals.

The Center for Science in the Public Interest, which led a petition in 2022 urging the FDA to take action, applauded the move, but called it long overdue. The group pointed to the fact that the dye had already been banned in cosmetics, but remained legal in food and drinks, until now.

“At long last, the FDA is ending the regulatory paradox of Red 3 being illegal for use in lipstick, but perfectly legal to feed to children in the form of candy,” the group said in a statement.

In addition to pressure from advocacy groups, nearly two dozen lawmakers recently called on the FDA to take action for the sake of children’s safety, with their letter stating, “No aesthetic reason could justify the use of a carcinogen in our food supply.”

Other countries, including Japan, Australia and New Zealand, have already restricted or banned the use of Red No. 3 in food products. Now, the U.S. is moving to follow suit.

The FDA is giving manufacturers until 2027 to remove the dye from their products, with an additional year for drug makers to comply with the new regulations.
