It’s a storyline people have heard before. Two conservative groups are suing the Biden administration over its latest student loan forgiveness program.
The legal challenges over the White House’s prior attempt to forgive college debt went all the way to the Supreme Court, with the bench ruling against the mass debt cancellation. Critics are calling this loan forgiveness program “a back-door attempt at cancellation.”
The plan would cancel $39 billion in debt for more than 800,000 borrowers, dependent on income and how long a person has been paying on their loans. It’s something the two conservative groups argue is another overstep by the Biden administration.
The Mackinac Center for Public Policy and the Cato Institute say that sort of action is not an executive privilege and would need authorization from Congress. A similar argument was used against Biden’s initial, and ultimately failed, forgiveness plan.
The Education Department responded with a statement calling the challenge “a desperate attempt from right-wing special interests to keep hundreds of thousands of borrowers in debt.”
A federal judge will decide whether to temporarily block the plan while the case plays out in court.
