PA election official apologizes for remarks on ignoring election laws

A Pennsylvania election official is facing backlash after comments she made about disregarding court rulings to count ballots that had been deemed invalid by the courts. Bucks County Commissioner Diane Ellis-Marseglia apologized Wednesday, Nov. 20, for saying, “precedent by a court doesn’t matter anymore in this country.”

“The passion in my heart got the best of me, and I apologize again for that,” Diane Ellis-Marseglia said during a commissioner’s meeting. “We all make mistakes, and I made a mistake. Because I am an elected official, I am held to a far higher standard than everybody else.”

The comments were made during a public meeting, where the commissioner and another commissioner voted to count about 600 ballots that lacked signatures or dates. These ballots had been ruled invalid by the Pennsylvania Supreme Court before the election.

The decision has sparked strong objections from local Republicans and legal experts, particularly as it comes amid a closely watched recount in Pennsylvania’s U.S. Senate race, where Republican Dave McCormick narrowly defeated incumbent Democratic Sen. Bob Casey by fewer than 20,000 votes.

While the commissioner apologized for her comments disregarding legal precedent, she defended the decision to count the ballots, arguing that rejecting them would “disenfranchise voters” over what she described as clerical errors.

Bucks County voted to count the invalid ballots despite the state’s highest court ruling against it. However, after a lawsuit from McCormick’s campaign, the Pennsylvania Supreme Court ordered all counties to “abide by its past rulings” and refrain from counting undated and unsigned ballots.

Democratic Gov. Josh Shapiro, D, weighed in this week, siding with the GOP position, stating, “Any insinuation that our laws can be ignored or do not matter is irresponsible and does damage to faith in our electoral process.”

A Pennsylvania ELECTION official is facing intense backlash after comments she made about ignoring court rulings to GO AHEAD AND count ballots THE COURTS RULED WERE INVALID.

THE BUCKS COUNTY COMMISSIONER APOLOGIZING ON WEDNESDAY –

FOR SAYING QUOTE “PRECEDENT BY A COURT DOESN’T MATTER ANYMORE IN THIS COUNTRY”.

The passion in my heart got the best of me and I apologize again for that.

We all make mistakes and I made a mistake, and because I am an elected official, I am held to a far higher standard than everybody else.

THE COMMISSIONER’S comments were made during a public meeting, where she and another Democratic commissioner voted to count around 600 ballots that lacked dates or signatures. These ballots had been declared invalid by the Pennsylvania Supreme Court before the election. The commissioners’ decision has drawn strong objections from local Republicans and legal experts, especially as it comes amid a closely watched recount in Pennsylvania’s U.S. Senate race WHERE REPUBLICAN DAVE MCCORMICK EDGED OUT INCUMBENT DEMOCRAT BOB CASEY BY LESS THAN 20 THOUSAND VOTES.

WHILE THE COMMISSIONER APOLOGIZED FOR HER COMMENTS DISREGARDING LEGAL PRECEDENT –

SHE JUSTIFIED HER ACTIONS OF STILL COUNTING BALLOTS WITH MISSING DATES OR SIGNATURES – SAYING IT “DISENFRANCHIZES VOTERS” FOR TOSSING BALLOTS OVER WHAT SHE DESCRIBED AS CLERICAL ERRORS.

BUCKS COUNTY ALONG WITH TWO OTHERS INCLUDING PHILADELPHIA –

HAD THEIR ELECTION OFFICIALS VOTE TO STILL COUNT THE INVALID BALLOTS –

DESPITE THE STATE’S HIGH COURT RULING FOR THEM NOT TO.

BUT AFTER A LAWSUIT FROM MCCORMICK’S CAMPAIGN –

THE STATE SUPREME COURT ORDERED ALL OF THE COUNTIES TO “ABIDE BY ITS PAST RULINGS” ABOUT THE UNDATED AND UNSIGNED BALLOTS **NOT BEING COUNTED.

DEMOCRATIC GOVERNOR JOSH SHAPIRO EVEN WEIGHED IN THIS WEEK, BACKING THE GOP POSITION AND SAYING “ANY INSINUATION THAT OUR LAWS CAN IGNORED OR DO NOT MATTER IS IRRESPONSIBLE AND DOES DAMAGE TO FAITH IN OUR ELECTORAL PROCESS.”

The DOGE Plan: Musk, Ramaswamy detail vision for government efficiency

Listen

Elon Musk and Vivek Ramaswamy gave further detail on their plans to teaming up with President-elect Donald Trump to overhaul the federal government through a new initiative, the Department of Government Efficiency (DOGE). The plan aims to cut federal regulations, reduce the government workforce, and save taxpayers billions by targeting wasteful spending.

Here's an indisputable truth about Vivek Ramaswamy: He put his money where his mouth is. Here's how much he spent to run for president.
Reuters

Musk and Ramaswamy detailed the DOGE plan in a Wall Street Journal op-ed published Wednesday, Nov. 20, emphasizing that many federal regulations exceed Congress’s authority and stifle economic growth. They intend to review these regulations under recent Supreme Court rulings, including West Virginia v. EPA and Loper Bright v. Raimondo, to recommend sweeping rollbacks via executive action.

The plan also calls for large-scale staff reductions across federal agencies, aligning workforce sizes with constitutionally mandated duties. DOGE’s leaders propose incentives for early retirement, voluntary severance and a mandatory return to in-office work schedules to encourage voluntary resignations.

On spending, the initiative targets more than $500 billion in annual expenditures Musk and Ramaswamy say are unauthorized or misused, including funds for international grants, public broadcasting and organizations like Planned Parenthood. The Pentagon’s failure to pass audits for seven consecutive years highlighted additional opportunities for savings through improved procurement processes.

Critics, including federal employee unions, warn the plan is out of touch with the practicalities of government operations and risks overstepping executive authority. Musk and Ramaswamy argued their approach will reduce bureaucratic overreach, aligning the federal government with constitutional principles by July 4, 2026.

ENTREPRENEURS ELON MUSK AND VIVEK RAMASWAMY ARE OUTLINING WHAT THEY’RE CALLING THE ‘DOGE PLAN TO REFORM GOVERNMENT,’ IN AN OPINION PIECE FOR THE WALL STREET JOURNAL… AND IT’S ALREADY STIRRING DEBATE ACROSS THE POLITICAL SPECTRUM.

UNDER THE PLAN, MUSK AND RAMASWAMY SAY THEY AIM TO CUT THE SIZE OF THE FEDERAL GOVERNMENT BUDGET BY HUNDREDS OF BILLIONS… ROLLING BACK WHAT THEY CALL “ILLICIT REGULATIONS,” AND SAVING TAXPAYERS BILLIONS. THEY’VE TEAMED UP WITH PRESIDENT-ELECT DONALD TRUMP TO LEAD THE DEPARTMENT OF GOVERNMENT EFFICIENCY… OR DOGE… A VOLUNTEER-BASED INITIATIVE DESIGNED TO STREAMLINE GOVERNMENT OPERATIONS.

Vivek Ramaswamy
“It’s no secret that there is a 4th branch of government… the administrative state that makes most of the rules… creates a federal bureaucracy that’s hampering our economy. So what do we wanna do? We want to go in and slash and burn that bureaucracy… to help Americans. Stimulate the economy… and to restore self governance again-”

THEIR FIRST TARGET? FEDERAL REGULATIONS.

MUSK AND RAMASWAMY SAY MANY OF THESE RULES ARE UNCONSTITUTIONAL AND NOT AUTHORIZED BY CONGRESS. THEY’RE CITING TWO RECENT SUPREME COURT RULINGS:

IN WEST VIRGINIA V. EPA, THE COURT RULED AGENCIES CAN’T IMPOSE MAJOR REGULATIONS WITHOUT EXPLICIT APPROVAL FROM CONGRESS. AND IN LOPER BRIGHT V. RAIMONDO… THE CHEVRON DOCTRINE WAS OVERTURNED, MEANING COURTS NO LONGER DEFER TO AGENCIES’ INTERPRETATIONS OF THE LAW.

MUSK AND RAMASWAMY ARGUE THESE CASES SUGGEST MANY CURRENT FEDERAL REGULATIONS EXCEED THE AUTHORITY CONGRESS HAS GRANTED.

DOGE PLANS TO IDENTIFY THOUSANDS OF REGULATIONS THEY BELIEVE OVERSTEP AGENCY AUTHORITY. THE IDEA IS TO HAVE PRESIDENT TRUMP PAUSE ENFORCEMENT AND BEGIN RESCINDING THEM THROUGH EXECUTIVE ORDERS.

BUT IT DOESN’T STOP THERE. MUSK AND RAMASWAMY ALSO WANT TO TACKLE THE FEDERAL WORKFORCE.

THEY MAINTAIN FEWER REGULATIONS MEAN FEWER EMPLOYEES ARE NEEDED. DOGE IS PROPOSING LARGE-SCALE REDUCTIONS IN FEDERAL STAFF, USING EARLY RETIREMENT AND SEVERANCE PACKAGES TO EASE TRANSITIONS.

THEY’RE ALSO PLANNING TO REQUIRE FEDERAL EMPLOYEES TO RETURN TO THE OFFICE FIVE DAYS A WEEK… A MOVE THEY SAY WILL PROMPT VOLUNTARY RESIGNATIONS… ADDING, “IF FEDERAL EMPLOYEES DON’T WANT TO SHOW UP, AMERICAN TAXPAYERS SHOULDN’T PAY THEM FOR THE COVID-ERA PRIVILEGE OF STAYING HOME.”

AS FOR TAXPAYER SAVINGS, DOGE IS TARGETING OVER $500 BILLION IN ANNUAL SPENDING THEY CLAIM IS UNAUTHORIZED OR MISUSED.

THIS INCLUDES 535 MILLION A YEAR FOR THE CORPORATION FOR PUBLIC BROADCASTING… 1 AND A HALF BILLION FOR INTERNATIONAL GRANTS… AND NEARLY 300 MILLION TO PROGRESSIVE ORGANIZATIONS LIKE PLANNED PARENTHOOD.

THE LARGEST CHUNK OF MONEY IN THE FEDERAL BUDGET IS IN SOCIAL SECURITY… AT NEARLY 1 AND A HALF TRILLION. INTEREST ON THE NATIONAL DEBT CLOCKS IN AT NEARLY 900 BILLION. MEDICARE, DEFENSE AND VETERANS BENEFITS COMBINE TO MORE THAN 2 TRILLION. ALL THESE PROGRAMS ACCOUNT FOR ABOUT 65-PERCENT OF ALL FEDERAL SPENDING.

WHILE TRUMP PUBLICLY VOWED NOT TO TOUCH ANY OF THESE PROGRAMS… HE DID PROPOSE MAKING CUTS IN 2020

MUSK AND RAMASWAMY ALSO POINT TO THE PENTAGON, WHICH HAS FAILED ITS SEVENTH CONSECUTIVE AUDIT, AS AN AREA RIPE FOR REFORM. WITH AN $800 BILLION ANNUAL BUDGET, THEY SAY TIGHTENING PROCUREMENT PROCESSES COULD SAVE BILLIONS.

NOW, NOT EVERYONE’S ON BOARD. FEDERAL EMPLOYEE UNIONS HAVE CRITICIZED THE PLAN, CALLING IT OUT OF TOUCH WITH HOW THE GOVERNMENT ACTUALLY OPERATES. AND CRITICS WORRY THE SWEEPING USE OF EXECUTIVE AUTHORITY COULD LEAD TO MORE OVERREACH, NOT LESS.

MUSK AND RAMASWAMY INSIST THEIR GOAL IS SIMPLE: A LEANER, MORE EFFICIENT GOVERNMENT THAT STILL OPERATES WITHIN CONSTITUTIONAL LIMITS. THEY’VE SET A DEADLINE TO WRAP UP THEIR WORK BY JULY 4TH, 2026… AMERICA’S 250TH ANNIVERSARY.

Former Rep. Matt Gaetz, R-Fla., is out as attorney general nominee and out of a job after he resigned from the House of Representatives when he was nominated. Despite that, Gaetz could still be back in Congress this January.

Gaetz resigned on Nov. 14 with the following letter to Speaker Mike Johnson, R-La.,“Sir, I hereby resign as a United States representative for Florida’s First Congressional District, effective immediately. And I do not intend to take the oath of office for the same office in the 119th Congress to pursue the position of Attorney General in the Trump administration.”

The House book of precedents states resignations cannot ordinarily be withdrawn, so it’s final for the 118th Congress. But the 119th will begin Jan. 3 and Gaetz won reelection for his district in the Florida panhandle by more than 30 points.

Fox’s Chad Pergram reports if Gaetz wants to be sworn in, he would have to withdraw the portion of the resignation letter that states, “I do not intend to take the oath of office for the same office in the 119th Congress.”

The House of Representatives may not be Gaetz’s only option to get himself back on Capitol Hill.

Sen. Marco Rubio, R-Fla., is nominated to be President-elect Trump’s secretary of state, and as a respected member of the chamber, he’s on a glide path to confirmation.

Florida Gov. Ron DeSantis, R, is responsible for appointing a replacement.

There are a number of names being floated, the president-elect’s daughter-in-law Lara Trump, Lt. Gov. Jeanette Nunez, Florida’s Attorney General Ashley Moody and former Florida House Speaker Paul Renner.

Gaetz could put his name up for consideration.

DeSantis said he’ll conduct vetting and interviews over the next several weeks and make a selection by the beginning of January

Northeast faces threat to water supply as drought hits NYC and New Jersey

Listen
Share

New data released from the U.S. Geological Survey on Thursday, Nov. 21, revealed water supplies are being threatened in at least one part of the country. In the Northeast, severe drought conditions have left rivers, channels and reservoirs at historically low levels.

Hydrologists are especially concerned because fall is typically when they see bodies of water at their highest levels as they replenish from heavy use during the summer months.

One environmental expert noted, the massive dry up is something one would only “expect to see once every 100 years.”

For example, the Cambridge Reservoir in Massachusetts, which can reportedly hold up to 1.5 billion gallons of water currently sits at just 50% capacity.

Officials warn that small communities that manage their own water supplies are at the greatest risk as water levels in smaller reservoirs typically dry up at much faster rates than larger reservoirs.

The dry conditions have prompted New Jersey to issue its first drought warning in nearly a decade and for New York City to follow suit by issuing its first drought warning in more than 20 years.

Earlier this week, NYC paused a $2 billion project to repair an aqueduct that supplies water to half its residents and other communities in the Hudson Valley as Mayor Eric Adams, D, cited extremely dry conditions.

Even with more rain in the forecast in the coming days, officials caution it may take months to recover from the drought, and if conditions worsen, they did not rule out mandatory water usage restrictions.

High winds combined with little to no rain have also fueled wildfires in New Jersey and New York, leading to at least one death, in a region typically known to be “water rich.”

[JACK AYLMER]

NEW DATA RELEASED FROM THE U-S GEOLOGICAL SURVEY REVEALS WATER SUPPLIES ARE BEING THREATENED ACROSS THE U-S NORTHEAST DUE TO SEVERE DROUGHT… LEAVING RIVERS, CHANNELS AND RESERVOIRS THROUGHOUT THE REGION AT HISTORICALLY LOW LEVELS.

HYDROLOGISTS ARE ESPECIALLY CONCERNED BECAUSE FALL IS TYPICALLY WHEN YOU SEE BODIES OF WATER AT THEIR HIGHEST LEVELS AS THEY REPLENISH FROM HEAVY USE DURING THE SUMMER.

ONE ENVIRONMENTAL EXPERT NOTED, THE MASSIVE DRY UP IS SOMETHING WE’D “EXPECT TO SEE ONCE EVERY 100 YEARS.”

ONE EXAMPLE IS THE CAMBRIDGE RESERVOIR IN MASSACHUSETTS, WHICH CAN HOLD UP TO ONE-POINT-FIVE BILLION GALLONS… BUT CURRENTLY SITS AT 50 PERCENT CAPACITY.

OFFICIALS WARN SMALL COMMUNITIES MANAGING THEIR OWN WATER ARE AT THE BIGGEST RISK…. AS WATER LEVELS IN SMALLER RESERVOIRS DRY UP AT MUCH FASTER RATES.

THE CONDITIONS PROMPTED NEW JERSEY TO ISSUE ITS FIRST DROUGHT WARNING IN NEARLY A DECADE. NEW YORK CITY IS ALSO FOLLOWING SUIT, ISSUING ITS FIRST DROUGHT WARNING IN MORE THAN TWENTY YEARS.

EARLIER THIS WEEK, NEW YORK CITY PAUSED A TWO-BILLION DOLLAR PROJECT TO REPAIR AN AQUEDUCT SUPPLYING WATER TO HALF ITS RESIDENTS AND OTHER COMMUNITIES IN THE HUDSON VALLEY.

CITING THE EXTREMELY DRY WEATHER.

EVEN WITH MORE RAIN IN THE FORECAST IN THE COMING DAYS, OFFICIALS CAUTION IT MAY TAKE MONTHS TO RECOVER, AND IF CONDITIONS WORSEN… HAVEN’T RULED OUT MANDATORY WATER USAGE RESTRICTIONS.

HIGH WINDS COMBINED WITH LITTLE TO NO RAIN HAVE ALSO FUELED WILDFIRES IN NEW JERSEY AND NEW YORK– LEADING TO AT LEAST ONE DEATH– IN A REGION TYPICALLY KNOWN TO BE “WATER RICH.”

Migrants in New York City to bypass in-person ICE check-ins: Report

Listen

Migrants in New York City will soon be able to bypass in-person check-ins at their local Immigration and Customs Enforcement (ICE) office, Homeland Security sources reportedly told the New York Post. Currently, asylum-seekers awaiting a court hearing must regularly report in person at their local ICE office.

The database for the current system flags arrest warrants for migrants to ICE officials.

The outgoing Biden administration is allegedly loosening those restrictions. The administration is also planning to launch a new ICE app where migrants can check-in virtually.

Homeland Security sources told the Post the new ICE app is reportedly “glitchy” and “unreliable.” They believe it will make it easier for migrants to flee.

Immigration officials will enroll up to 100,000 migrants in New York City in the new system before President-elect Donald Trump’s inauguration.

The Biden administration is also looking to implement an initiative allowing migrants to challenge orders for electronic tracking while awaiting their immigration hearings, the Post said.

Former Acting Customs and Border Protection Commissioner Mark Morgan told the paper the last-minute move is “the opposite of a peaceful transition of power,” calling it an “obstructionist transition.”

“What they’re trying to do in the last final day, they’re going to try to put up as many roadblocks and obstacles and throw as many grenades as they can on their way out,” Morgan said.

Ed Cuccia, a New York City immigration attorney, told The Telegraph he had clients use the piloted app when it was being tested earlier this year. He said he doesn’t think the system will change much, calling in-person check-ins “a bit of a joke.”

He said, either way, the immigration system is backlogged, with some of his clients not receiving court dates until 2023.

Trump has said he plans to carry out mass deportations when he returns to office.

MIGRANTS IN NEW YORK CITY WILL SOON BE ABLE TO BYPASS IN-PERSON CHECK-INS AT THEIR LOCAL IMMIGRATION AND CUSTOMS ENFORCEMENT OFFICE, HOMELAND SECURITY SOURCES REPORTEDLY TOLD THE NEW YORK POST.

CURRENTLY, ASYLUM SEEKERS AWAITING A COURT HEARING MUST REGULARLY REPORT IN PERSON AT THEIR LOCAL ICE OFFICE.

THE DATABASE FOR THE CURRENT SYSTEM FLAGS ARREST WARRANTS FOR MIGRANTS TO ICE OFFICIALS.

THE OUTGOING BIDEN ADMINISTRATION IS ALLEGEDLY LOOSENING THOSE RESTRICTIONS AND PLANNING TO LAUNCH A NEW ICE APP WHERE MIGRANTS CAN CHECK-IN VIRTUALLY.

HOMELAND SECURITY SOURCES TELL THE POST – THE NEW ICE APP IS APPARENTLY “GLITCHY” AND “UNRELIABLE” AND WILL MAKE IT EASIER FOR MIGRANTS TO FLEE.

UP TO 100,000 MIGRANTS IN NEW YORK CITY ARE SET TO BE ENROLLED IN THE NEW SYSTEM BEFORE PRESIDENT-ELECT DONALD TRUMP’S INAUGURATION.

THE BIDEN ADMINISTRATION IS ALSO LOOKING TO IMPLEMENT AN INITIATIVE ALLOWING MIGRANTS TO CHALLENGE ORDERS FOR ELECTRONIC TRACKING WHILE AWAITING THEIR IMMIGRATION HEARINGS, THE POST SAYS.

FORMER ACTING CUSTOMS AND BORDER PROTECTION COMMISSIONER MARK MORGAN TOLD THE PAPER THE LAST-MINUTE MOVE IS “THE OPPOSITE OF A PEACEFUL TRANSITION OF POWER” CALLING IT AN “OBSTRUCTIONIST TRANSITION.”

“WHAT THEY’RE TRYING TO DO IN THE LAST FINAL DAY, THEY’RE GOING TO TRY TO PUT UP AS MANY ROADBLOCKS AND OBSTACLES AND THROW AS MANY GRENADES AS THEY CAN ON THEIR WAY OUT,” MORGAN SAID.

ED CUCCIA, A NEW YORK CITY IMMIGRATION ATTORNEY, TOLD THE TELEGRAPH THAT HE HAD CLIENTS USE THE PILOTED APP WHEN IT WAS BEING TESTED EARLIER THIS YEAR AND SAYS HE DOESN’T THINK THE SYSTEM WILL CHANGE MUCH, CALLING IN-PERSON CHECK-INS “A BIT OF A JOKE.”

HE SAYS EITHER WAY THE IMMIGRATION SYSTEM IS BACKLOOGED WITH SOME OF HIS CLIENTS NOT RECEIVING COURT DATES UNTIL 2023.

TRUMP HAS SAID HE’S PLANNING MASS DEPORTATIONS WHEN HE’S BACK IN OFFICE.

It’s the latest in what’s been an annual process each fall since 2018, as the weather cools off.

People from countries in Central America have traveled in groups to make it more difficult for Mexico’s government to arrest or deport them, and to avoid having to pay traffickers to get them to the border.

But the journey has often been dangerous. Often times, drug cartels have threatened and abducted migrants as they make their way toward the U.S.

Policy changes by the Biden administration created a process where migrants need to make appointments on U.S. Customs and Border Protection’s CBP One app for their chance to be processed.

However, people in the caravan still want to be close to the border to avoid missing their appointments.

Trump has pledged a strict crackdown on migrants. He’s said he’s looking to get rid of rules that allow many to temporarily stay in the country.

He’s also planning to deport millions of undocumented immigrants, in a plan that includes government raids and the use of detention camps.

Another caravan traveling earlier this month broke up after news emerged of Trump’s win. Roughly half of the people in the nearly 3,000-person caravan turned back in the days after the election.

Biden to cancel $4.7B in Ukrainian debt as time in office nears end

With just weeks left in his presidency, President Joe Biden is working to secure support for Ukraine before President-elect Donald Trump takes office on Jan. 20. As he hits the lame-duck portion of his presidency, Biden announced on Wednesday, Nov. 20, the forgiveness of $4.7 billion in Ukrainian debt.

The president does have the authority to forgive the debt due to U.S. Congress granting him the power in an April funding bill that approved $9.4 billion in loan forgiveness.

The move by Biden is important to the White House because some within the administration are reportedly concerned Trump could limit U.S. funding for the war.

The White House and Ukraine said the loan forgiveness will give Ukraine the ability to maintain its defense while keeping government functions intact.

However, some Republicans have issues with the plan. They argue loan forgiveness before leaving office won’t have the proper oversight and sets a bad precedent for lame-duck presidential actions.

Other actions taken by the Biden administration recently include shipping anti-personnel land mines to Ukraine and authorizing Ukraine’s armed forces to strike targets in Russia with long-range ATACMS.

The White House says its decisions are in response to Moscow using around 10,000 North Korean troops to clear Ukrainian forces out of the Kursk region.

PRESIDENT BIDEN’S TIME IN OFFICE IS ALMOST OVER–BUT WHEN IT COMES TO UKRAINE–THE LAME DUCK PRESIDENT HAS BEEN A BUSY BEAVER.

HIS LATEST MOVE INCLUDES FORGIVING NEARLY 5 BILLION DOLLARS IN UKRAINIAN DEBT.

PRESIDENT BIDEN DOES HAVE THE AUTHORITY TO FORGIVE THE DEBT, BECAUSE CONGRESS GAVE IT TO HIM WHEN IT APPROVED UP TO 9 BILLION DOLLARS IN LOAN FORGIVENESS IN ITS APRIL FUNDING BILL. THE MOVE ALSO MATTERS BECAUSE A LOT OF PEOPLE IN AND OUT OF D-C ARE CONCERNED THE INCOMING TRUMP ADMINISTRATION COULD LIMIT U-S FUNDING FOR KYIV’S WAR TO REPEL MOSCOW.

THE WHITE HOUSE AND UKRAINE SAY THE LOAN FORGIVENESS WILL GIVE UKRAINE THE ABILITY TO MAINTAIN ITS DEFENSE WHILE KEEPING GOVERNMENT FUNCTIONS INTACT.

WHILE CONGRESS DOES HAVE THE POWER TO OVERTURN BIDEN’S REQUEST, THE STATE DEPARTMENT SAYS IT EXPECTS LAWMAKERS TO SUPPORT THE DEBT CANCELLATION.

TO NO ONE’S SURPRISE, SOME REPUBLICANS ARE VOICING CONCERNS.

ARGUING THE LOAN FORGIVENESS BEFORE LEAVING OFFICE WON’T HAVE THE PROPER OVERSIGHT AND SETS A BAD PRECEDENT FOR LAME-DUCK PRESIDENTIAL ACTIONS.

OTHER LAME-DUCK ACTIONS TAKEN BY BIDEN INCLUDE SHIPPING ANTI-PERSONAL LAND MINES TO UKRAINE AND AUTHORIZING UKRAINE’S ARMED FORCES TO STRIKE TARGETS IN RUSSIA WITH LONG-RANGE ATACMS.

THE BIDEN ADMINISTRATION SAYS ITS DECISIONS ARE IN RESPONSE TO MOSCOW USING AROUND 10-THOUSAND NORTH KOREAN TROOPS TO CLEAR UKRAINIAN FORCES OUT OF THE KURSK REGION.

In a 5-0 decision, the court ruled Smollett’s due process rights were violated. The case has been sent to a lower court for formal dismissal.

The 2019 incident

Smollett, a former “Empire” star, claimed he was attacked in downtown Chicago. He said two men assaulted him while yelling racist and homophobic slurs. Smollett also alleged they placed a noose around his neck.

Police launched a “full scale hate crimes investigation,” which made national headlines. However, prosecutors later alleged the attack was staged.

Prosecutors’ claims

Authorities said Smollett was upset over hate mail he received on set. They claimed he paid the two men – who happened to be brothers – $3,500 to fake the attack. The brothers testified that Smollett gave them lines to yell, including references to then-President Trump’s “Make America Great Again” slogan.

In 2019, Smollett was charged with 16 counts of disorderly conduct. However, Cook County State’s Attorney Kim Foxx’s office dropped the charges. Smollett agreed to forfeit a $10,000 bond and complete community service.

Refiled charges and conviction

A special prosecutor was appointed in 2020 and reopened the case. Smollett was tried on six counts of disorderly conduct in 2021. He was convicted on five counts by a jury.

Smollett was sentenced to 150 days in jail, 30 months of probation and $130,000 in restitution. He served six days before being released pending his appeal.

Illinois Supreme Court ruling

The Illinois Supreme Court ruled the second prosecution violated Smollett’s rights. The court said the original nonprosecution agreement should have been honored.

Justice Elizabeth Rochford wrote, “What would be more unjust than the resolution of any one criminal case would be a holding from this court that the state was not bound to honor agreements upon which people have detrimentally relied.”

The court’s decision ends years of legal battles and public scrutiny. Smollett has maintained his innocence throughout the case.
