TWO HOMELAND SECURITY AGENTS ARE FACING FEDERAL CHARGES FOR ALLEGEDLY SELLING DRUGS SEIZED AS EVIDENCE. INVESTIGATORS SAY THE AGENTS, DAVID COLE AND NICHOLAS KINDLE, USED THEIR POSITIONS TO TAKE SYNTHETIC DRUGS, KNOWN AS “BATH SALTS,” FROM FEDERAL EVIDENCE LOCKERS AND THEN SOLD THEM THROUGH CONFIDENTIAL INFORMANTS IN UTAH.
THE FBI SAYS THE SCHEME RAN FROM 2021 TO 2024 AND MAY HAVE GENERATED UP TO $300,000. OFFICIALS ALLEGE THE AGENTS MISLED OTHER LAW ENFORCEMENT OFFICERS, CLAIMING THE DRUGS WERE FOR INVESTIGATIONS. INSTEAD, THEY ALLOWED INFORMANTS TO RESELL THE SUBSTANCES ON THE STREET.
AUTHORITIES SAY THE AGENTS ALSO STOLE CASH, A DIAMOND RING, AND A PERUVIAN ANTIQUITY FROM EVIDENCE. COURT DOCUMENTS REVEAL ENCRYPTED MESSAGES WERE USED TO COORDINATE EXCHANGES, SOMETIMES LEAVING DRUGS IN PARKING LOT TRASH CANS FOR PICKUP.
DAVID COLE HAS BEEN INDICTED BY A GRAND JURY AND FACES UP TO 20 YEARS IN PRISON IF CONVICTED. NICHOLAS KINDLE, CHARGED SEPARATELY, FACES ADDITIONAL COUNTS AND COULD FACE 25 YEARS. BOTH REMAIN SUSPENDED BUT HAVE NOT BEEN FORMALLY DISMISSED.
THE FBI AND DHS INSPECTOR GENERAL ARE LEADING THE INVESTIGATION, WITH COLE’S TRIAL SET FOR FEBRUARY AND KINDLE’S FIRST COURT APPEARANCE SCHEDULED FOR LATER THIS MONTH.
