JUST DAYS INTO IDAHO’S 2025 LEGISLATIVE SESSION…A STATE REPRESENTATIVE IS CALLING ON THE U-S SUPREME COURT TO PUT AN END TO SAME SEX MARRIAGES.
HEATHER SCOTT REPRESENTS THAT STATE’S 1ST DISTRICT. SHE WANTS IDAHO TO REGAIN THE POWER TO REGULATE MARRIAGE LAWS.
ON TUESDAY, SCOTT INTRODUCED A MEASURE ASKING THE STATE HOUSE COMMITTEE TO CHALLENGE THE HIGH COURT’S 2015 RULING.
THE LANDMARK CASE, OBERGEFELL VERSUS HODGES, IMMEDIATELY PUT PROTECTIONS IN PLACE FOR SAME SEX COUPLES TO MARRY.
THE SWEEPING LEGALIZATION IS IN DIRECT OPPOSITION WITH WHAT’S WRITTEN IN IDAHO’S STATE CONSTITUTION – THAT MARRIAGE IS BETWEEN ONE MAN AND ONE WOMAN.
DURING TUESDAY’S HEARING, SCOTT SAYS THE SUPREME COURT’S DECISION WAS AN “ILLEGITIMATE OVERREACH” AND BYPASSED THE DEMOCRATIC PROCESS.
THE RESOLUTION STATES “court rulings are not laws and only legislatures elected by the people may pass laws.”
IDAHO DEMOCRATIC PARTY LEADERS CRITICIZED SCOTT’S MEASURE, CALLING IT A ‘SAD DISTRACTION’ AND THE GOVERNMENT SHOULDN’T DECIDE WHO ADULTS CAN LOVE – SAYING IN A STATEMENT:
“This is yet another example of the extreme wing of the Republican Party ginning up divisive social issues in order to create problems where none exist.”
ALTHOUGH THE COMMITTEE VOTED TO PASS THE MEASURE…ITS WORTH NOTING IT WON’T CARRY LEGAL WEIGHT.
INSTEAD IT ACTS AS A SYMBOL AND REINSTATES THE ORIGINAL DEFINITION OF MARRIAGE.
IF PASSED BY BOTH LEGISLATIVE CHAMBERS, A COPY WILL BE SENT TO THE SUPREME COURT.
IN 2014 IDAHO’S DISTRICT COURT FOUND BANS ON SAME SEX MARRIAGE UNCONSTITUTIONAL.
PAVING THE WAY FOR LEGAL RECOGNITION OF SAME SAME SEX UNIONS AND STRIKING DOWN THE STATE’S CONSTITUTIONAL AMENDMENTS PROHIBITING SUCH MARRIAGES.
